End User Agreement for EnigmaRoom

These Terms and Conditions ("Agreement") govern your participation in and use of *EnigmaRoom* (the "Escape Rooms"), along with any related websites, booking systems, online content, or features provided by or on behalf of EnigmaRoom ("Company", "we", "our", or "us"). Please read this Agreement carefully before engaging with our escape rooms or any associated services (collectively, the "Services").

By booking a session, entering a room, creating an account, or otherwise accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with these Terms, you must refrain from using the Services or participating in our rooms.

  • 1. License to Participate:
    Subject to compliance with this Agreement, the Company grants you a limited, personal, non-exclusive, non-transferable right to participate in our escape rooms solely for entertainment purposes. All intellectual property rights in and to the puzzles, room designs, branding, and related content remain the property of the Company or its licensors.
  • 2. Eligibility and Registration:
    To reserve and take part in our rooms, you must be at least thirteen (13) years of age, or the minimum age required in your jurisdiction. If under eighteen (18), participation is permitted only with the consent of a parent or guardian. You agree to provide accurate information when booking or registering.
  • 3. Participant Conduct and Safety:
    You are responsible for your actions during an escape session. Unsafe or inappropriate behavior, including damaging property, tampering with restricted areas, or harassing staff or other players, is strictly prohibited and may result in removal without refund. All participants must follow safety instructions provided by the Company.
  • 4. Tickets and Booking:
    Access to escape rooms requires a valid booking. Tickets are non-transferable, non-exchangeable, and hold no cash value. The Company reserves the right to change or cancel bookings due to unforeseen circumstances, with refunds or rescheduling offered at its discretion.
  • 5. Payments and Cancellations:
    By purchasing a booking, you agree to pay all applicable charges, fees, and taxes. Payments are processed through approved providers, and you agree to their terms. Refunds or cancellations are subject to our cancellation policy, and fraudulent or unauthorized transactions may result in refusal of service.
  • 6. Modifications and Updates:
    The Company may at any time alter, redesign, or replace puzzles, storylines, or room settings. We also reserve the right to close rooms temporarily or permanently, with or without notice. Experiences may evolve over time to ensure variety and creativity.
  • 7. Suspension or Refusal of Access:
    The Company may refuse service, remove participants, or ban accounts for violating this Agreement, unsafe behavior, or prolonged inactivity. Upon such action, you may lose access to bookings or progress, with no obligation of compensation from the Company.
  • 8. Privacy and Data Use:
    By booking or using our Services, you consent to the collection and processing of personal data in accordance with our Privacy Policy. Information may include contact details, booking history, and device data. Such information may be shared with third parties for fraud prevention, analytics, or support, subject to data protection laws.
  • 9. Disclaimer of Warranties:
    The Services are provided "as is" and "as available," without any guarantees, express or implied. We do not warrant that puzzles will always be solvable, free of errors, or available at all times. Participation is at your own risk, and to the maximum extent permitted by law, all warranties are disclaimed.
  • 10. Limitation of Liability:
    To the fullest extent permitted by law, the Company is not liable for indirect, incidental, or consequential damages, including personal injury, loss of property, or lost opportunities arising from participation in the Services. Certain jurisdictions may not allow such limitations, so they may not apply to you.
  • 11. Indemnification:
    You agree to indemnify and hold harmless the Company, its affiliates, and staff from any claims, damages, or expenses resulting from your breach of this Agreement, unsafe actions, or violation of third-party rights during your use of the Services.
  • 12. Dispute Resolution:
    Any disputes shall first be attempted to be resolved amicably. If unresolved, disputes will be subject to binding arbitration under the laws of the Company’s jurisdiction. You waive the right to jury trials or class actions, where permitted by law.
  • 13. Force Majeure:
    The Company is not responsible for delays, cancellations, or failures caused by events beyond our control, including natural disasters, technical issues, power outages, strikes, or government restrictions.
  • 14. Entire Agreement and Severability:
    This Agreement represents the full understanding between you and the Company regarding the Services. If any clause is found unenforceable, the remaining provisions remain valid to the fullest extent of the law.

By continuing to use *EnigmaRoom*, you confirm that you have read, understood, and agreed to this Agreement. The Company reserves the right to update or modify these Terms at any time, and continued participation constitutes acceptance of such changes.
